Terms of Service — Driplane

1. Agreement to Terms

By accessing or using Driplane (“the Service”), operated at driplane.app, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Driplane is an email sequence and drip campaign platform. The Service allows you to create, manage, and automate email sequences using your own email provider API key. Driplane does not send emails directly — all email delivery is handled by your configured email provider under their terms and pricing.

3. Account and Access

You must authenticate to use the Service. You are responsible for maintaining the security of your account and any API keys or credentials you provide. You agree not to share your account credentials with unauthorized parties.

4. Payment and Refunds

Driplane is available for a one-time payment of $47 USD. This grants you lifetime access to the Service, including future updates. No recurring charges will be applied.

Refund requests may be considered on a case-by-case basis within 14 days of purchase. Contact us at [email protected] to request a refund.

5. Acceptable Use

You agree not to use the Service to:

Send unsolicited or spam emails
Violate any applicable laws or regulations, including CAN-SPAM, GDPR, CASL, or similar legislation
Transmit malicious content, malware, or phishing attempts
Impersonate any person or entity
Interfere with or disrupt the Service or its infrastructure
Attempt to gain unauthorized access to other users' data
Use the Service to harass, threaten, or harm any individual
Exceed reasonable usage limits that negatively impact other users

You are solely responsible for the content of your emails and compliance with all applicable email marketing laws. You must have proper consent from recipients before sending emails through the Service.

6. Your Data and Credentials

You retain ownership of all data you provide to the Service, including contact lists, email content, and sequence configurations. Your API keys and credentials are encrypted and used solely to interact with your email provider on your behalf.

You may export or delete your data at any time. Upon account deletion, all associated data is permanently removed within 30 days.

7. Intellectual Property

The Service, including its design, code, and documentation, is owned by Driplane. Your purchase grants you a license to use the Service, not ownership of any part of it. You may not copy, modify, distribute, or reverse-engineer any part of the Service.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or modifications that temporarily affect availability. We are not liable for any losses resulting from service downtime.

9. Limitation of Liability

The Service is provided “as is” without warranties of any kind, express or implied. To the maximum extent permitted by law, Driplane shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.

Our total liability shall not exceed the amount you paid for the Service ($47 USD).

10. Indemnification

You agree to indemnify and hold harmless Driplane from any claims, damages, losses, or expenses arising from your use of the Service, your email content, or your violation of these terms.

11. Termination

We reserve the right to suspend or terminate your access to the Service if you violate these terms or engage in abusive behavior. Upon termination, your right to use the Service ceases immediately. You may also terminate your account at any time by contacting support.

12. Changes to Terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the new terms. We will notify users of material changes via email or in-app notification.

13. Governing Law

These terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these terms or the Service shall be resolved through good-faith negotiation before pursuing formal legal action.
